               Nanking, Feb. 7.

    In the solemn atmosphere following a memorial service for Japanese officers and men killed in action, General Matsui, Commander-in-Chief of the Japanese Expeditionary Force in Central China, to-day instructed his commanders to tighten discipline in their units in order to “enhance the prestige of the lmperial Army.”

    Among the high officers so adressed on the wind-swept Nanking Parade Ground was Lieutenant-General Prince Yasuhiko Asaka, a member of the Imperial family.

    Speaking at length on [t]he determination of the Japanese forces in the face of the prospect of lengthy hostilities, General Matsui called the attention of his subordinates to the necessity of putting an end to various reports affecting the prestige of the Japanese troops.

    This action, said to be unprecedented in the annals of the Japanese Army, was taken in the face of recurring adverse comment on reported treaches of dicipline by Japanese troops. ─ Domei.

南京慰霊祭で松井大将が命令

今後は威信を厳格に守れと

               南京、二月七日

  戦没日本軍将兵の慰霊祭から引き続く厳粛な雰囲気の中、遠征軍総司令官の松井石根大将は本日、部下司官たちに「皇軍の威信宣揚」のため配下部隊の規律を引き締める様に訓示した。

 吹きさらしの南京観閲場で訓示を受けた高級指揮官の中には皇族の朝香鳩彦王中将宮殿下もいた。

 長期戦化の見通しに直面した日本軍の決意に関し長く時間を割いて語った松井将軍は、日本軍部隊の威信に影響する各種報道に終止符を打つ必要について隷下将兵に注意を喚起した。

 日本陸軍の歴史に前例がないと言われるこうした将軍の行動は、報道された日本軍部隊の規律違反に対して繰り返される不都合な論評に直面してなされたものである。

 1:30より派遣軍慰霊祭。終つて松井軍司令官より隊長全部に対し次の要旨の訓示あり。南京入城の時は誇らしき気持ちにて、その翌日の慰霊祭またその気分なりしも、本日は悲しみの気持ちのみなり。それはこの50日間に幾多の忌まはしき事件を起こし、戦没将士の樹てたる功を半減するに至りたればなり。何をもつてこの英霊に見えんやと言ふにあり。

 午後、慰霊祭に参列す。予は去年、南京入城翌日、最初の慰霊祭を自ら祭主として営み、今日また50日祭ともいふべきこの祭事に遭ふものなれど、さきのものは戦勝の誇と気分にて、むしろ忠霊に対し悲哀の情少なかりしも、今日はただただ悲哀その物に捉はれ、責任感の太く胸中に迫るを覚えたり。けだし南京占領後の軍の諸不始末とその後地方自治、政権工作等の進捗せざるに起因するものなり。よつて式後参集各隊長を集め、予のこの所感を披露して一般の戒飭を促せり。(2月7日)

 ○○【2·7】松井最高指揮官は7日、各隊長を○○に集合せしめ、今後における軍紀振刷により皇軍威武の宣揚と、長期持久に対処すべき将兵の覚悟につき、厳に訓示を与えた。

中支の敵産をわが軍管理

 上海【2·9】中支方面占領地区における国民政府所有の財産管理に関し、陸海軍当局は九日午後六時、左の重要談話を発表した。

   △陸海軍当局談

 帝國陸海軍は、中支方面占領地域一帯において新たなる支那政権確立せらるるまで、右地域一帯に存在する敵産を軍事管理のもとに置き、調査、保管その他、必要なる緊急措置を講じることに決せり。敵産の名義変更にして昭和十二年八月十三日以降に属するものはこれを認めず、ただし同日より昭和十三年一月六日に至る期間において右に関し正当なる法律上の手続きおよび代価支払いを
完了したるものは別に考慮することあるべし。

 ▲租界内外一律に実施 上海【二·一〇】中支方面占領地域一帯に存在する国民政府、地方政府、軍閥、さらに政府要人、抗日巨頭の所有にかかるあらゆる財産を軍事管理下に置き、新政権の成立を見るまで必要なる緊急措置を講ずることに方針を決定したことは九日の陸海軍當局談により明かとなた。しかしてもしこれら敵に所属する財産が
国際關関係の微妙複雑なる租界内に所属する場合、わが軍がいかなる態度に出づるかに関し列国は深甚なる関心を寄せ成行きを注目しているが、かかる場合における軍の方針は大体、次のごとくであると見られる。すなわち、

軍としては敵産に重点を置き、これを管理する事を原則とするものであって、該敵産の所在場所が租界内にあろうと租界外にあろうと、わが方の敵に利用させまいとする目的に毫末もその差別をつけんとするものではない。したがって租界内にあってもそれが国民政府あるいは要人連の所有経営にかかる会社、銀行、工場その他の不動産である以上、仮藉するところなくこれを管理せんとする方針である。しかし第三国の個人または国体に名義変更されたものでも、調査の結果、それが事変突発の八月十三日以降に名義変更した敵産たることが確認されれば、租界の内外たるを問はずこれを管理することを建前とするものである。現に税関、新聞検閲所、電信局、放送局のごときは租界内にあっても軍管理下に置かれてその機能を発揮しており、今後はさらに全面的に租界内各種敵産に対しても及ぶ筈であるが、目下のところ右のわが軍の方針に対し、直接的反対ないし阻止機運はほとんど感ぜられない。

上海【二·九】中支方面占領地區に於ける國

は九日午後六時左の重要談話を發表した

  △陸海軍當局談

帝國陸海軍は中支方面占領地域一帶に於
て新たなる支那政權確立せらるゝまで右
地域一帶に存在する敵產を軍事管理の下
に置き調査保管その他必要なる緊急措置
を講じることに決せり、敵產の名義變更
にして昭和十二年八月十三日以降に屬す
るものは之を認めず、但し同日より昭和
十三年一月六日に至る期間に於て右に關
し正當なる法律上の手續及び代價支拂を
完了したるものは別に考慮することある
可し

日中和平工作の渦中で

 松井最高指揮官の訓戒

…翌十八日朝、南京に着いた。「同盟」の従軍記者が、あらゆる苦労をしてきたのに、私らの場合は、当時の情況からみれば全くの大名旅行であって、相済まんと思った。着く前に、今日は陸海軍の合同慰霊祭があると深堀中佐が知らせてくれたので、「ぜひ特別に参列させてもらいたい」と申し込んだ。松井最高指揮官の顔も見たかったからであった。

 まず「同盟」の南京支局を訪れたが、一両日中に再開というので、「同盟」の従軍記者たちが臨時に中山路のある空家を占拠していたので、そこを訪ね、同僚たちを労おうとしたが、居合せたのは連絡員だけで、記者やカメラマンの多くは、取材のため、八方飛びまわっていて、残念ながら会えなかった。

 慰霊祭定刻二時の半時間前に入場せねばならぬので、深堀報道部長とともに、急ぎ祭場の故宮飛行場へ行った。その日は曇りで、風は強くはなかったが、膚を刺すような寒さであった。夜来の小雨が雪と変じ、式場は薄化粧をしていた。参列部隊は定刻までに整列を終えつつあった。見れば、祭場の中央には東面して、白布の祭壇がしつらえられ、祭壇の上には神酒を中に、海の幸、山の幸の供物の数々が供えられ、その後方には高さ数メートルの四角の白木に「中支那方面軍陸海軍戦病没将士霊標」と認められていた。戦没した従軍記者、従軍カメラマンたちも合せ祀られていたのであった。周囲には白布を垂らした真榊が立ち並び、野戦斎場の簡素な情景の中に、森厳たるものがあった。

 斎主としては、陸軍を代表して松井最高指揮官、海軍を代表して長谷川「支那方面艦隊」司令長官。両氏が定刻に喇叭の音とともに現れ、祭壇近くに着席した。一段後方に朝香中将宮、柳川中将、近藤戦隊司令官、さらに後方に各部隊首脳部将士約五百名が参列していた。式は神式に則って進められ、松井・長谷川両指揮官の祭文が厳粛に読まれ、ついで日高参事官が川越大使の弔辞を代読、両斎主の玉串奉奠があり、その間、陸海軍の喇叭手が吹き鳴らす「国の鎮め」のうちに、参列将士一斉に捧げ銃を行い、慰霊祭はいともおごそかに終った。

 私はそれで終ったかと思っていると、松井最高指揮官が、つと立ち上り、朝香宮をはじめ参列者一同に対し、説教のような演説を始めた。深堀中佐も私も、何が始まったのかと、訝りながら聴いていると、「おまえたちは、せっかく皇威を輝かしたのに、一部の兵の暴行によって、一挙にして、皇威を墜してしまった」という叱責のことばだ。しかも、老将軍は泣きながらも、凛として将兵らを叱っている。「何たることを、おまえたちは、してくれたのか。皇軍として、あるまじきことではないか。おまえたちは、今日より以後は、あくまで軍規を厳正に、絶対に無辜の民を虐げてはならぬ。それが、また戦病没者への供養となるであろう」云々と、切々たる訓戒のことばであった。私は、心に「松井さん、よくやったなあ」と叫び、深堀中佐を顧みて、「日本軍の暴行、残虐は、今、世界に知らされているんだ。何とかして松井大将の訓戒のニューズを世界に撒きたいのだ。ぜひとも報道部長の同意を得たい」と頼むと、深堀中佐は、「松本君、僕は大賛成だ。だが、今すぐ方面軍の参謀からOKをとってくるから、ちょっと待っていてくれ」という。

 二十分ほどすると、深堀中佐が戻ってきて、「参謀は、あまり賛成しないといっている」というので、私は、「深堀中佐、このニューズの打電を許可してくれれば、報道部長として、日本のための最大の貢献になるのですよ。これを許可しないというほうが報道部長の責任になるのだと考えられないですか」と詰め寄る。深堀中佐は、しばし考えていたが、「松本君、君の考え方が正しい。参謀が何といおうとかまわない。自分は報道部長の責任において、ニューズの発表、打電を許可する」「すごい。ありがとう。虐殺、暴行の噂は、少なからず聞いてはいたが、松井大将の話を聞いてみると、現実に、ずいぶんわるいことをやったらしいではありませんか。日本軍の名誉回復の一助としたいのです。ぜひこの電報をやりましょうや」「松本君、やってくれ」。私は、深堀中佐の手をとって、握手をした。

 「南京大虐殺」事件

 翌十九日、私は上海に帰ってすぐ支社に出社、東京向けの発信をするとともに、英文部長の堀口(瑞典)君に、英訳してロイテル通信や各英字紙に配ってくれと頼んだ。堀口君も大賛成。その翌朝、短いながらも、その記事は、上海の『ノース・チャイナ・デイリーニューズ』など各英字紙に掲載された。しかし松井最高指揮官の態度は立派であったが、松井さんの訓戒の対象となった日本軍の南京その他における最も恥ずべき暴行、虐殺、放火、死体冒涜等の事実は、たえず私の心を痛めたのであった。

 山と江とに挟まれたる今までに見ざる僻村寒村、おまけに支那兵に荒され米なく、食に困りて悲鳴を挙ぐ。

 総出にて物資徴発なり。然るに午後一・〇〇頃、突然、歩兵第65聯隊と山砲兵第Ⅲ大隊、騎兵第17大隊を連れて南京攻撃に参加せよとの命令、誠に有難きことながら突然にして、行李は鎮江に派遣しあり、人は徴発に出であり、態勢甚だ面白からず
 併し午後五・〇〇出発、夜行軍をなし三里半余の四蜀街に泊す、随分ひどき家にて南京騒ぎあり。
  南京攻撃
   十二月十三日 晴
 例に依り到る所に陣地ある地帯を過ぎ、晴暘鎮を経て前進、霞棲街に泊する心算なりし所 焼かれて適当の家なく更に若干前進中、先遣せし田山大隊 午後一時 烏竜山砲台を(騎兵第17大隊は午後三・〇〇)占領せり、南京は各師団掃蕩中との報あり、直に距離を伸して邵家塘に泊す
   十二月十四日 晴
 他師団に砲台をとらるるを恐れ午前四時半出発、幕府山砲台に向ふ、明けて砲台の付近に到れば投降兵莫大にして仕末に困る
 幕府山は先遣隊により午前八時占領するを得たり、近郊の文化住宅、村落等皆敵の為に焼かれたり
 捕虜の仕末に困り、恰も発見せし上元門外の学校に収容せし所、一四、七七七名を得たり、斯く多くては殺すも生かすも困つたものなり、上外門外の三軒屋に泊す

   慰安婦問題についての我が国の取組

1.日韓間の慰安婦問題

(1)慰安婦問題は、1990年代以降、日韓間で大きな外交問題となってきたが、日本はこれに真摯に取り組んできた。日韓間の財産及び請求権の問題は、1965年の日韓請求権・経済協力協定で法的に解決済みであるが、その上で、元慰安婦の方々の現実的な救済を図るとの観点から、1995年、日本国民と日本政府が協力して財団法人「女性のためのアジア平和国民基金」(略称:「アジア女性基金」)を設立し、韓国を含むアジア各国等の元慰安婦の方々に対し、医療・福祉支援事業及び「償い金」の支給を行うとともに、歴代総理大臣からの「おわびの手紙」を届ける等、最大限の努力をしてきた。
(2)さらに、日韓両政府は、多大なる外交努力の末に、2015年12月の日韓外相会談における合意によって、慰安婦問題の「最終的かつ不可逆的な解決」を確認した。また、日韓両首脳間においても、この合意を両首脳が責任を持って実施すること、また、今後、様々な問題に対し、この合意の精神に基づき対応することを確認した。この合意については、潘基文国連事務総長(当時)を始め、米国政府を含む国際社会も歓迎している。

 この合意に基づき、2016年8月、日本政府は韓国政府が設立した「和解・癒やし財団」に対し、10億円の支出を行った。「和解・癒やし財団」は、これまで、合意時点でご存命の方々47人のうち35人に対し、また、お亡くなりになっていた方々199人のうち64人のご遺族に対し、資金を支給しており、多くの元慰安婦の方々の評価を得ている。

(3)しかしながら、2016年12月、韓国の市民団体により、在釜山総領事館に面する歩道に慰安婦像が設置された。その後、2017年5月に新たに文在寅政権が発足し、外交部長官直属の「慰安婦合意検討タスクフォース」による検討結果を受け、2018年1月9日には、康京和外交部長官が、①日本に対し再協議は要求しない、②被害者の意思をしっかりと反映しなかった2015年の合意では真の問題解決とならない等とする韓国政府の立場を発表した。2018年7月、韓国女性家族部は、日本政府の拠出金10億円を「全額充当」するため予備費を編成し、「両性平等基金」に拠出すると発表した。また、11月には、女性家族部は、「和解・癒やし財団」の解散を推進すると発表した。

(4)解散の発表は、日韓合意に照らして問題であり、日本として到底受け入れられるものではない。韓国政府は、文在寅大統領を含め、「合意を破棄しない」、「日本側に再交渉を要求しない」ことを対外的に繰り返し明らかにしてきているものの、日本は、日韓合意の下で約束した措置をすべて実施してきており、国際社会が韓国側による合意の実施を注視している状況である。日本政府としては、引き続き、韓国側に日韓合意の着実な実施を強く求めていく考えである。

2.国際社会における慰安婦問題の取扱い

(1)慰安婦問題を含め、先の大戦に関わる賠償並びに財産及び請求権の問題について、日本政府は、米国、英国、フランス等45か国との間で締結したサンフランシスコ平和条約及びその他二国間の条約等に従って誠実に対応してきており、これらの条約等の当事国との間では、個人の請求権の問題も含めて、法的に解決済みである。

(2)その上で、日本政府は、元慰安婦の方々の名誉回復と救済措置を積極的に講じてきた。1995年には、日本国民と日本政府の協力の下、元慰安婦の方々に対する償いや救済事業等を行うことを目的として、「アジア女性基金」が設立された。アジア女性基金には、日本政府が約48億円を拠出し、また、日本人一般市民から約6億円の募金が寄せられた。日本政府は、元慰安婦の方々の現実的な救済を図るため、元慰安婦の方々への「償い金」や医療・福祉支援事業の支給等を行うアジア女性基金の事業に対し、最大限の協力を行ってきた。アジア女性基金の事業では、元慰安婦の方々285人(フィリピン211人、韓国61人、台湾13人)に対し、
国民の募金を原資とする「償い金」(一人当たり200万円)が支払われた。また、アジア女性基金は、これらの国・地域において、日本政府からの拠出金を原資とする医療・福祉支援事業として一人当たり300万円(韓国・台湾)、120万円(フィリピン)を支給した(合計金額は、一人当たり500万円(韓国・台湾)、320万円(フィリピン))。さらに、アジア女性基金は、日本政府からの拠出金を原資として、インドネシアにおいて、高齢者用の福祉施設を整備する事業を支援し、また、オランダにおいて、元慰安婦の方々の生活状況の改善を支援する事業を支援した。

(3)個々の慰安婦の方々に対して「償い金」及び医療・福祉支援が提供された際、その当時の内閣総理大臣橋本龍太郎内閣総理大臣小渕恵三内閣総理大臣森喜朗内閣総理大臣及び小泉純一郎内閣総理大臣)は、自筆の署名を付したおわびと反省を表明した手紙をそれぞれ元慰安婦の方々に直接送った。

(4)2015年の内閣総理大臣談話に述べられているとおり、日本としては、20世紀において、戦時下、多くの女性たちの尊厳や名誉が深く傷つけられた過去を胸に刻み続け、21世紀こそ女性の人権が傷つけられることのない世紀とするため、リードしていく決意である。

(5)このような日本政府の真摯な取組にもかかわらず、「強制連行」や「性奴隷」といった表現のほか、慰安婦の数を「20万人」又は「数十万人」と表現するなど、史実に基づくとは言いがたい主張も見られる。

 これらの点に関する日本政府の立場は次のとおりである。

 ●「強制連行」

 これまでに日本政府が発見した資料の中には、軍や官憲によるいわゆる強制連行を直接示すような記述は見当たらなかった。(このような立場は、例えば、1997年12月16日に閣議決定した答弁書にて明らかにしている。)

 ●「性奴隷」

 「性奴隷」という表現は、事実に反するので使用すべきでない。この点は、2015年12月の日韓合意の際に韓国側とも確認しており、同合意においても一切使われていない。

 ●慰安婦の数に関する「20万人」といった表現

 「20万人」という数字は、具体的裏付けがない数字である。慰安婦の総数については、1993年8月4日の政府調査結果の報告書で述べられているとおり、発見された資料には慰安婦の総数を示すものはなく、また、これを推認させるに足りる資料もないので、慰安婦総数を確定することは困難である。

3(6)日本政府は、これまで日本政府がとってきた真摯な取組や日本政府の立場について、国際的な場において明確に説明する取組を続けている。具体的には、日本政府は、国連の場において、2016年2月の女子差別撤廃条約第7回及び第8回政府報告審査を始めとする累次の機会を捉え、日本の立場を説明してきている。また、2017年2月、日本政府は、米国・ロサンゼルス郊外のグレンデール市に設置されている慰安婦像に係る米国連邦最高裁判所における訴訟において、日本政府の意見書を同裁判所に提出した。

 Japan's Efforts on the Issue of Comfort Women

1. The issue of comfort women between Japan and the Republic of Korea (ROK)

(1) As the issue of comfort women has been a major diplomatic issue in Japan-ROK relations since the 1990s, Japan has sincerely dealt with it. The issue concerning property and claims between Japan and the ROK was legally settled in 1965 through the Agreement on the Settlement of Problems Concerning Property and Claims and on the Economic Cooperation between Japan and the ROK. However, from the perspective of facilitating feasible remedies for the former comfort women, the people and the Government of Japan cooperated to establish the “Asian Women’s Fund” in 1995, through which they carried out medical and welfare projects and provided “atonement money” to each former comfort woman in Asian and other countries, including the ROK. In addition, successive Prime Ministers have sent letters expressing their “apology and remorse” to former comfort women. The Government of Japan has made every effort as mentioned above.

(2) Furthermore, as a result of great diplomatic efforts, the Governments of Japan and the ROK confirmed that the issue of comfort women was “resolved finally and irreversibly” with the agreement reached at the Japan-ROK Foreign Ministers’ Meeting in December 2015. The Japanese and ROK leaders also confirmed that they would take responsibility as leaders to implement this agreement, and that they would deal with various issues based on the spirit of this agreement. This agreement was welcomed by the international community, including the then Secretary-General of the United Nations Ban Ki-moon and the U.S. Government.

 In accordance with this agreement, in August 2016, the Government of Japan contributed 1 billion yen to “the Reconciliation and Healing Foundation” established by the Government of the ROK. The Foundation provided financial support to 35 out of 47 former comfort women who were alive at the time of the agreement, and to the bereaved families of 64 out of 199 former comfort women who were deceased at the time. The agreement has been received positively by many former comfort women.

(3) However, in December 2016, a comfort woman statue ※1 was installed on the sidewalk facing the Consulate-General of Japan in Busan by a civic group in the ROK. Subsequently, the Moon Jae-in administration was newly inaugurated in May 2017. Based on the results of the assessment made by the Taskforce to Review the Agreement on Comfort Women Issue under the direct supervision of the Minister of Foreign Affairs of the ROK, Foreign Minister Kang Kyung-wha announced the position of the Government of the ROK on January 9, 2018 as follows: i) it will not ask for a renegotiation with Japan; and ii) the 2015 agreement, which fails to properly reflect the wishes of the victims, does not constitute a true resolution of the issue. In July 2018, the Ministry of Gender Equality and Family of the ROK announced that it would arrange a reserve budget to “appropriate the full amount” of the 1 billion yen contributed by the Government of Japan and contribute this amount to “the Gender Equality Fund”. In November, the Ministry of Gender Equality and Family announced that it would proceed with its dissolution of “the Reconciliation and Healing Foundation”

※1 For the sake of convenience and practicality, the statues in front of the Embassy of Japan in Seoul and the Consulate-General of Japan in Busan are referred to as “comfort woman statues.” However, the use of this term is not a reflection of the recognition that these statues accurately embody the reality of these women at that time.

(4) The dissolution announcement is totally unacceptable for Japan in light of the 2015 Japan-ROK agreement. While the Government of the ROK, including President Moon Jae-in, repeatedly stated in public that it “will not abandon the agreement” and “will not ask for a renegotiation with Japan,” Japan has implemented all of its commitments under the Japan-ROK agreement and the international community is closely awaiting the ROK’s implementation of the agreement. The Government of Japan will continue to call on the Government of the ROK to steadily implement the Japan-ROK agreement.

2. The comfort women issue in the international community

(1) The Government of Japan has sincerely dealt with the issues of reparations, property, and claims pertaining to the Second World War, including the comfort women issue, under the San Francisco Peace Treaty, which the Government of Japan concluded with 45 countries, including the United States, the United Kingdom, and France, and through other bilateral treaties, agreements, and instruments. These issues including those of claims of individuals have already been legally settled with the parties to these treaties, agreements, and instruments.

(2) On this basis, the Government of Japan has actively taken measures to recover the honor of former comfort women and to provide remedies for them. In 1995, the AWF was established with the cooperation of the people and the Government of Japan for the purpose of carrying out atonement and remedy projects for former comfort women. The Government of Japan provided a total of 4.8 billion yen. Approximately 600 million yen was donated to the AWF by the people of Japan. The Government of Japan extended maximum cooperation to the AWF, which implemented medical and welfare support and provided “atonement money,” to offer realistic relief to former comfort women. As part of the AWF’s projects, “atonement money” (2 million yen per person), which was funded by donations from Japanese people, was provided to 285 former comfort women (211 for the Philippines, 61 in the Republic of Korea, 13 in Taiwan). Moreover, the AWF provided funds in those countries/areas for medical and welfare support funded with contributions by the Government of Japan. (3 million yen per person in the Republic of Korea and Taiwan, 1.2 million yen for the Philippines) (for a total of 5 million yen per person in the Republic of Korea and Taiwan, 3.2 million yen per person in the Philippines). Furthermore, using funds contributed by the Government of Japan, the AWF extended support for projects to promote social welfare services for elderly people in Indonesia as well as projects to help improve the living conditions of former comfort women in the Netherlands.

(3) When the “atonement money” as well as the medical and welfare support were provided to individual former comfort women, then-Prime Ministers (namely, PM Ryutaro Hashimoto, PM Keizo Obuchi, PM Yoshiro Mori and PM Junichiro Koizumi) sent signed letters expressing their apology and remorse directly to each former comfort woman.

(4) As stated in the Statement by the Prime Minister issued in 2015, Japan will engrave in its heart the past, when the dignity and honour of many women were severely injured during wars in the 20th century. Japan will lead the world in making the 21st century an era in which women’s human rights are not infringed upon.

(5) Despite such sincere efforts by the Government of Japan, there are claims that can hardly be said to be based on historical facts, such as the allegations of “forceful taking away” of comfort women and “sex slaves” as well as the figures such as “200,000 persons” or “several hundred thousands” for the total number of comfort women.

 The Government of Japan’s position regarding these claims is as follows;

 ●“Forceful taking away”

 “Forceful taking away” of comfort women by the Japanese military and government authorities could not be confirmed in any of the documents that the Government of Japan was able to identify. (This position is stated, for example, in a written answer approved by the Cabinet on December 16, 1997 to a question by a member of the House of Representatives.)

 ●“Sex slaves”

 The expression of “sex slaves” contradicts the facts so that it should not be used. This point was confirmed with the ROK on the occasion of the Japan-ROK Agreement in December 2015 and the expression “sex slaves” is not used in the agreement.

 ●Figures such as “200,000 persons” for the total number of comfort women

 The figure “200,000 persons” lacks concrete evidence. As stated in the report of the Government study’s result of August 4, 1993, it is virtually impossible to determine the total number of comfort women as no documents have been found which either indicate the total number or give sufficient ground to establish an estimate.

(6) The Government of Japan has been making efforts to provide clear explanations regarding its sincere efforts and official position in international fora. Specifically, at the UN, the Government of Japan has explained its position at a number of opportunities such as during the examination of the
Seventh and Eighth Periodic Reports by the Government of Japan on the implementation of the Convention on the Elimination of All Forms of Discrimination against Women in February 2016. In February 2017, the Government of Japan also submitted its amicus curiae brief to the U.S. Supreme Court for the trial concerning a comfort woman statue installed in Glendale in the suburbs of Los Angeles, United States.

 Die Frage der Comfort Women

1. Die Frage der Comfort Women zwischen Japan und der Republik Korea (ROK)

(1) Seit sich die Frage der Comfort Women in den 1990er Jahren zu einer wichtigen Angelegenheit innerhalb der Beziehungen zwischen Japan und der ROK entwickelt hat, stellt sich Japan dieser Frage in aufrichtiger Weise. Die Fragen des Vermögens und der Ansprüche zwischen Japan und der ROK wurden 1965 durch das Abkommen über die Beilegung der Fragen in Bezug auf Vermögen und Ansprüche und über wirtschaftliche Zusammenarbeit zwischen Japan und der ROK rechtlich geregelt. Jedoch wirkten unter dem Aspekt der Gewährung einer praktischen Unterstützung für die ehemaligen Comfort Women die Bevölkerung und die Regierung von Japan zusammen, um 1995 den „Asian Women’s Fund“ ins Leben zu rufen, durch den sie medizinische und soziale Projekte durchführten sowie ehemaligen Comfort Women in Asien und weiteren Staaten, einschließlich der ROK, eine Entschädigung (Atonement Money) zukommen ließen. Zusätzlich haben seitdem alle Premierminister den ehemaligen Comfort Women Entschuldigungsschreiben zukommen lassen. Die Regierung von Japan hat auf diese Weise alle Anstrengungen unternommen.

(2) Darüber hinaus haben die Regierungen Japans und der ROK als Resultat großer diplomatischer Anstrengungen bestätigt, dass die Frage der Comfort Women mit der bei der Zusammenkunft der Außenminister Japans und der ROK im Dezember 2015 erzielten Übereinkunft „abschließend und unumkehrbar gelöst“ ist. Die Staats- und Regierungschefs Japans und der ROK haben ebenfalls bestätigt, dass sie ihrer Verantwortung für die Umsetzung dieser Übereinkunft gerecht werden sowie dass sie bei verschiedenen Fragen auf der Grundlage des Geistes dieser Übereinkunft verfahren werden. Diese Übereinkunft wurde von der internationalen Gemeinschaft einschließlich des Generalsekretärs der Vereinten Nationen, Ban Ki-moon, sowie der US-Regierung und der Deutschen Regierung begrüßt.Entsprechend dieser Übereinkunft hat die Regierung von Japan im August 2016 den Betrag von einer Milliarde Yen an die von der Regierung der ROK ins Leben gerufenen „Stiftung Versöhnung und Heilung“ zukommen lassen. Diese Stiftung gewährte 35 von 47 zum Zeitpunkt der Übereinkunft noch lebenden ehemaligen Comfort Women sowie den Hinterbliebenen von 64 von 199 ehemaligen Comfort Women, die zu diesem Zeitpunkt bereits verstorben waren, eine finanzielle Unterstützung. Die Übereinkunft wurde von zahlreichen ehemaligen Comfort Women positiv aufgenommen.

(3) Jedoch wurde im Dezember 2016 die Statue einer Comfort Woman ※1 auf dem Bürgersteig vor dem Japanischen Generalkonsulat in Busan von einer Bürgerinitiative in der ROK aufgestellt. Im Anschluss trat im Mai 2017 die Regierung von Moon Jae-in ihr Amt an. Auf der Grundlage der Resultate einer Bewertung, die von einer Task Force zur Überprüfung der Übereinkunft über die Frage der Comfort Women unter direkter Aufsicht des Außenministeriums der ROK durchgeführt wurde, gab Außenministerin Kang Kyung-wha am 9. Januar 2018 die Position der Regierung der ROK wie folgt bekannt: (a) die Regierung wird Japan nicht um Neuverhandlungen ersuchen und (b) die Übereinkunft von 2015, die nicht in der Lage ist, die Wünsche der Opfer angemessen widerzuspiegeln, stellt keine wirkliche Lösung dieser Frage dar. Im Juli 2018 gab das Ministerium für Geschlechtergleichstellung und Familien der ROK bekannt, dass es Haushaltsmittel „in der Höhe des vollen Betrags“ von einer Milliarde Yen, den die Regierung von Japan bereitgestellt hat, bereitstellen und diesen Betrag für den „Fonds für Geschlechtergerechtigkeit“ bereitstellen wird. Im November teilte das Ministerium für Geschlechtergleichstellung und Familien mit, dass es die Auflösung der „Reconsiliation and Healing Fundation“ in Angriff nehmen wird.

※1 Aus praktischen Erwägungen sowie aus Gründen der Bequemlichkeit werden die Statuen vor der Botschaft von Japan in Seoul sowie vor dem Japanischen Generalkonsulat in Busan als „Comfort Woman-Statuen“ bezeichnet. Jedoch ist die Verwendung dieses Begriffs nicht als Anerkennung dahingehend zu verstehen, dass diese Statuen die Realität dieser Frauen zum damaligen Zeitpunkt korrekt wiedergeben.

(4) Die Ankündigung der Auflösung ist mit Blick auf die Übereinkunft zwischen Japan und der ROK von 2015 für Japan völlig inakzeptabel. Während die Regierung der ROK einschließlich Präsident Moon Jae-in wiederholt öffentlich erklärt hat, dass sie „die Übereinkunft nicht aufgeben“ sowie „Japan nicht um Neuverhandlungen ersuchen wird“, hat Japan sämtliche Verpflichtungen im Rahmen der Übereinkunft zwischen Japan und der ROK erfüllt, und die internationale Gemeinschaft erwartet nun eine genaue Umsetzung der Übereinkunft durch die ROK. Die Regierung von Japan ruft die Regierung der ROK weiterhin dazu auf, die bilaterale Übereinkunft stetig umzusetzen.

2. Die Frage der Comfort Women innerhalb der internationalen Gemeinschaft

(1) Die Regierung von Japan hat die Fragen der Entschädigung, des Vermögens und der Ansprüche in Bezug auf den Zweiten Weltkrieg einschließlich der Frage der Comfort Women“ im Rahmen des Friedensvertrags von San Francisco, den die Regierung von Japan mit 45 Staaten geschlossen hat, darunter die Vereinigten Staaten, das Vereinte Königreich und Frankreich, sowie im Rahmen weiterer bilateraler Verträge u.Ä. in aufrichtiger Weise behandelt. Diese Fragen einschließlich der Frage individueller Ansprüche wurden mit den Vertragsstaaten dieser Verträge u.Ä. bereits rechtlich geregelt.

(2) Auf dieser Grundlage hat die Regierung von Japan in aktiver Weise Schritte unternommen, um die Ehre ehemaliger Comfort Women wiederherzustellen sowie ihnen Unterstützung zu gewähren. 1995 wurde der AWF gemeinsam von der Bevölkerung und der Regierung Japans eingerichtet mit dem Zweck, ehemaligen Comfort Women eine Entschädigung sowie Hilfsprojekte zuteilwerden zu lassen. Die Regierung von Japan hat insgesamt 4,8 Mrd. Yen bereitgestellt. Ca. 600 Mio. Yen erhielt der AWF als Spenden vonseiten der Bevölkerung von Japan. Die Regierung von Japan hat dem AWF ihre größtmögliche Zusammenarbeit gewährt; so führte der Fonds medizinische und soziale Unterstützung durch und zahlte eine Entschädigung (Atonement Money), um den ehemaligen Comfort Women praktische Hilfe zuteilwerden zu lassen. Als Teil der Projekte des AWF erhielten 285 ehemalige Comfort Women (211 in den Philippinen, 61 in der ROK sowie 13 in Taiwan) eine Entschädigung (Atonement Money) in Höhe von zwei Millionen Yen pro Person, die aus Spenden der Bevölkerung von Japan stammte. Darüber hinaus stellte der AWF diesen Staaten/Regionen Finanzmittel für medizinische und soziale Unterstützung aus Mitteln der Regierung von Japan zur Verfügung (3 Mio. Yen pro Person in der ROK und Taiwan sowie 1,2 Mio. Yen pro Person in den Philippinen; insgesamt 5 Mio. Yen pro Person in der ROK und Taiwan sowie 3,2 Mio. Yen in den Philippinen). Zudem unterstützte der AWF unter Verwendung von Mitteln, die von der Regierung von Japan bereitgestellt wurden, sowohl Projekte zur Verbesserung sozialer Wohlfahrtsdienstleistungen für ältere Menschen in Indonesien als auch Projekte zur Unterstützung der Verbesserung der Lebensumstände ehemaliger Comfort Women in den Niederlanden.

(3) Sowohl bei der Überweisung der Entschädigung (Atonement Money) als auch bei der Gewährung medizinischer und sozialer Unterstützung an einzelne ehemalige Comfort Women haben die damaligen Premierminister (namentlich PM Ryutaro Hashimoto, PM Keizo Obuchi, PM Yoshiro Mori und PM Junichiro Koizumi) von ihnen unterzeichnete Schreiben versandt, in denen sie ihre Entschuldigung und ihr Bedauern gegenüber den ehemaligen Comfort Woman unmittelbar zum Ausdruck gebracht haben.

(4) Wie in der Erklärung des Premierministers von 2015 zum Ausdruck gebracht wurde, wird Japan sich die Vergangenheit zu Herzen nehmen, als die Würde und Ehre zahlreicher Frauen während der Kriege des 20. Jahrhunderts schwer verletzt wurden. Japan wird die Welt dabei anführen, das 21. Jahrhundert zu einer Ära zu machen, in der die Menschenrechte von Frauen nicht verletzt werden.

(5) Trotz dieser aufrichtigen Anstrengungen vonseiten der Regierung von Japan gibt es Behauptungen, die nur schwer als auf historischen Fakten basierend bezeichnet werden können, wie die Vorwürfe eines „gewaltsamen Wegführens“ von Comfort Women und „Sexsklavinnen“ sowie von Zahlen wie „200.000 Personen“ oder „mehreren hunderttausend“ für die Gesamtzahl von Comfort Women.

Die Position der Regierung von Japan in Bezug auf diese Behauptungen ist wie folgt:

●„Gewaltsames Wegführen“

Ein „gewaltsames Wegführen“ von Comfort Women durch japanische Militär- und Regierungsbehörden lässt sich anhand der Dokumente, die die Regierung von Japan ermitteln konnte, nicht belegen. (Diese Position wurde z.B. in einer vom Kabinett bestätigten schriftlichen Antwort vom 16. 12. 1997 auf die Frage eines Abgeordneten des Unterhauses zum Ausdruck gebracht.)

●„Sexsklavinnen“
Der Ausdruck „Sexsklavinnen“ widerspricht den Tatsachen und sollte daher nicht verwendet werden. Dieser Punkt wurde gemeinsam mit der 4 ROK anlässlich der Übereinkunft Japans und der ROK im Dezember 2015 bestätigt, und der Ausdruck „Sexsklavinnen“ wurde in der Übereinkunft nicht verwendet.

●Zahlen wie z.B. „200.000 Personen“ als Gesamtzahl der Comfort Women

Die Zahl „200.000 Personen“ entbehrt konkreter Belege. Wie ein Bericht über die Ergebnisse einer Untersuchung durch die Regierung vom 04. 08. 1993 ausführt, ist es praktisch unmöglich, die Gesamtzahl von Comfort Women zu bestimmen, da keine Dokumente gefunden wurden, die entweder die Gesamtzahl angeben oder als ausreichende Grundlage für eine Schätzung dienen können.

(6) Die Regierung von Japan hat Anstrengungen unternommen, um in internationalen Foren ihre aufrichtigen Bemühungen sowie ihre offizielle Position eindeutig zu erläutern. Konkret hat die Regierung von Japan innerhalb der Vereinten Nationen ihre Position bei einer Reihe von Gelegenheiten erläutert, etwa während der Prüfung des 7. sowie 8. Berichts der Regierung von Japan über die Umsetzung des Überkommens über die Beseitigung jeder Form von Diskriminierung der Frau im Februar 2016. Im Februar 2017 übersandte die Regierung von Japan zudem anlässlich der Verhandlung über eine Comfort Woman-Statue, die in Glendale, einem Vorort von Los Angeles, aufgestellt wurde, ein Amicus Curiae-Schreiben an den Obersten Gerichtshof der Vereinigten Staaten.
